My basic question is if I have an existing MPLS connection to a remote office which is basically made up of static routes on both ends, can I also create a site-to-site VPN as a backup or will this cause a loop?
What I mean is can both be active at the same time. The MPLS and the Site to Site VPN?

You can have multiple routes to the same destiantion. But to make whole scenario work in a meaningful way you will need some mechanism which will be chosing which route to use depending on current network status (PBF, dynamic routing protocol, tunnel monitoring...)
